These Terms of Service constitute a legally binding agreement between the User and My Notice Track governing access to and use of the My Notice Track platform, including all associated software systems, monitoring architecture, dashboards, alert engines, credential management mechanisms, communication integrations, databases, interfaces, and related services (collectively referred to as the “Platform” or the “Service”).
By registering, subscribing, accessing, browsing, submitting credentials, or otherwise using the Platform, the User irrevocably acknowledges and agrees that such access or use constitutes full and unconditional acceptance of these Terms
If the User does not agree with any provision contained herein, the User must immediately discontinue use of the Platform.
The User further confirms that acceptance of these Terms is voluntary, informed, and not induced by misrepresentation, coercion, or undue influence.
DESCRIPTION AND LIMITED NATURE OF THE SERVICE
My Notice Track is a technology-enabled automated monitoring and notification system that periodically accesses specified government portals, including but not limited to the Goods and Services Tax portal and the Income Tax portal, based on credentials or identifiers voluntarily provided by the User.
The Platform is designed solely to detect the presence of statutory notices uploaded on such portals and to transmit alerts to the User via electronic communication channels, including but not limited to email and messaging platforms.
The Service is strictly limited to notification functionality and does not assume statutory compliance responsibility on behalf of the User.
The User expressly acknowledges that the Service is supplementary in nature and does not replace independent statutory vigilance or professional consultation.
ELIGIBILITY AND AUTHORITY TO USE THE SERVICE
The Service may be used only by individuals or entities who possess the legal capacity to contract under applicable law. If the User is registering on behalf of an entity, the individual completing the registration warrants that he or she has full authority to bind such entity to these Terms.
The Platform reserves the right to suspend or terminate access if it reasonably believes that the User lacks authority or capacity.
ACCOUNT REGISTRATION AND CREDENTIAL SECURITY
In order to access the Service, the User must create an account by providing accurate and complete information, including but not limited to name, email address, contact details, PAN, GSTIN, and other required identifiers.
The User warrants that all information provided during registration is true, accurate, current, and complete, and undertakes to update such information promptly if any changes occur.
The User is solely responsible for maintaining the confidentiality of account login credentials and for all activities occurring under the User’s account. Any unauthorised access or suspected breach must be reported immediately to the Platform.
The Platform shall not be liable for losses arising from unauthorised use of the User’s account where such use is attributable to the User’s failure to maintain confidentiality.
PORTAL ACCESS AND MONITORING DEPENDENCY
Where portal credentials are required for monitoring, the User warrants that the credentials provided are lawfully owned or authorised for monitoring purposes and that the User possesses full authority to permit such access.
The User acknowledges that monitoring functionality is entirely dependent upon valid credentials and continued accessibility of government portals.
If credentials are incorrect, expired, revoked, or restricted, the Platform shall not be responsible for failure to detect notices.
The User remains solely responsible for independently accessing official portals and verifying statutory communications.
SUBSCRIPTION, BILLING AND PAYMENT TERMS
Subscription fees are payable in advance on a monthly or annual basis, depending on the selected plan.
All payments are processed through authorised third-party payment gateways. Fees are exclusive of applicable Goods and Services Tax and any other statutory levies.
All subscription fees are non-refundable except where required by mandatory law.
Failure to make timely payment may result in suspension, restriction, or termination of Service access without prejudice to the Platform’s right to recover outstanding amounts.
The Platform reserves the right to modify subscription pricing upon providing reasonable notice. Continued use following such notice constitutes acceptance of revised pricing.
SERVICE AVAILABILITY
The Platform aims to maintain high service availability but does not guarantee uninterrupted or error-free operation.
Service availability may be affected by maintenance activities, software upgrades, portal downtime, network interruptions, or force majeure events.
DISCLAIMER OF WARRANTIES
The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.
The Platform disclaims all warranties including merchantability, fitness for a particular purpose, non-infringement, and accuracy.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, the Platform shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, business interruption, reputational damage, or statutory penalties.
The aggregate liability of the Platform shall not exceed the subscription fees paid by the User in the preceding twelve months.
INTELLECTUAL PROPERTY RIGHTS
All content, software, algorithms, trademarks, logos, and proprietary systems forming part of the Platform are owned exclusively by My Notice Track.
Unauthorised reproduction, modification, distribution, or commercial exploitation is strictly prohibited.
TERMINATION AND SUSPENSION
The Platform reserves the right to suspend or terminate access at its discretion where the User breaches these Terms, engages in fraudulent activity, or defaults in payment.
GOVERNING LAW AND JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of India.
Courts at Pune, Maharashtra shall have exclusive jurisdiction.
ARBITRATION
Any dispute arising out of or relating to these Terms shall be resolved by arbitration under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Pune.
SURVIVAL
Provisions relating to limitation of liability, indemnification, intellectual property, dispute resolution, and governing law shall survive termination.
