1. INTRODUCTION

This Privacy Policy governs the collection, processing, storage, use, disclosure, and protection of personal data by My Notice Track (“Platform”, “Service”, “we”, “us”, “our”). The Platform operates as a technology-enabled statutory notice monitoring and alert system designed to assist users in tracking notices published on designated government portals, presently limited to the Income Tax and Goods and Services Tax portals of the Government of India. By accessing, registering, subscribing, submitting credentials, or using the Platform in any manner, the User acknowledges that they have read, understood, and agreed to this Privacy Policy.

2. LEGAL BASIS AND REGULATORY COMPLIANCE

Personal data is processed in accordance with the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, and applicable rules framed thereunder. Processing is undertaken on the basis of voluntary consent, contractual necessity, legitimate business interests, and compliance with legal obligations.

3. NATURE AND LIMITED CHARACTER OF SERVICE

My Notice Track operates strictly as a monitoring and alert facilitation platform. The Service is limited to technological detection of statutory notices appearing on specified government portals based on credentials or identifiers voluntarily provided by the User, and transmission of alert notifications to the User via registered email and/or WhatsApp. The Platform does not control, influence, modify, prevent, or delay issuance of any notice by government authorities. The Platform does not guarantee real-time detection, uninterrupted availability, or prevention of penalties. Monitoring remains dependent upon portal accessibility, authentication mechanisms, and system availability of external government infrastructure. The Service does not replace independent statutory vigilance or professional compliance responsibility.

4. INFORMATION COLLECTED

The Platform may collect personal information including name, email address, mobile number, PAN, GSTIN, business details, subscription details, communication records, technical usage data, device information, access logs, and payment transaction references. Where monitoring functionality requires portal access, login credentials may be collected and stored in encrypted form solely for automated monitoring purposes.

5. PURPOSE OF DATA PROCESSING

Personal data is processed for the purpose of account creation, subscription management, portal monitoring, detection of notices, transmission of alerts, customer communication, consultation scheduling, billing, internal record-keeping, service improvement, cybersecurity monitoring, and regulatory compliance. Personal data shall not be sold, rented, or commercially traded.

6. ALERT TRANSMISSION AND USER RESPONSIBILITY

Upon detection of a notice appearing on the monitored portal, the Platform transmits an informational alert to the User via registered communication channels. Such alerts are automated notifications and do not constitute legal advice, compliance confirmation, statutory representation, or professional opinion. The User remains solely responsible for independently accessing the official portal, verifying notice content, reviewing statutory deadlines, and taking appropriate action within prescribed timelines. Failure to review alerts or access the portal does not transfer statutory responsibility to the Platform.

7. CONSULTATION AND PROFESSIONAL SERVICES

Users may voluntarily book consultation services after receiving alerts. Consultation services are advisory in nature and are based entirely on documents and information shared by the User. Consultation does not automatically include drafting, filing, submission, representation, or litigation services. If the User opts for drafting of replies, filing before authorities, rectifications, appeals, or representation services, such services shall be governed by a separate professional engagement and shall be charged at actual professional fees as agreed. Subscription fees for monitoring do not include professional representation unless expressly contracted in writing.

8. DATA SECURITY AND ENCRYPTION

The Platform implements commercially reasonable technical and organisational safeguards including encryption protocols, restricted access control, firewall protection, access logging, and security monitoring. Credential information is stored in encrypted format and access is limited to authorised system processes. Despite reasonable safeguards, no digital system can guarantee absolute immunity from cyber threats, and Users acknowledge inherent cybersecurity risks associated with online platforms.

9. DATA RETENTION

Personal data is retained for the duration of active subscription and for a reasonable period thereafter for audit, compliance, dispute resolution, or statutory obligations. Data may be retained longer where required under applicable law. Upon lawful request for deletion, data shall be erased unless retention is required by legal or regulatory obligation.

10. DATA SHARING AND DISCLOSURE

Personal data may be disclosed to authorised service providers including cloud hosting providers, payment gateways, messaging service providers, and compliance vendors solely for operational purposes. Data may also be disclosed where required by court order, statutory authority, regulatory directive, or lawful investigation. The Platform does not share personal data for third-party marketing purposes.

11. LIMITATION OF LIABILITY

To the maximum extent permitted under applicable law, My Notice Track shall not be liable for statutory penalties, interest, enforcement actions, attachment proceedings, business interruption, reputational harm, or consequential damages arising from missed notices, portal downtime, credential issues, regulatory changes, or user inaction. The aggregate liability of the Platform shall not exceed the subscription fees paid by the User during the preceding twelve months.

12. USER RIGHTS

Subject to applicable law, Users may request access, correction, or deletion of personal data, withdraw consent, or raise grievances regarding data processing practices. Withdrawal of consent may result in suspension or termination of monitoring services.

13. THIRD-PARTY LINKS

The Platform may provide links to external websites, including government portals and payment gateways. My Notice Track is not responsible for the privacy practices, content, or security standards of such third-party platforms.

14. CROSS-BORDER DATA TRANSFER

Data may be processed or stored on secure cloud infrastructure that may be located outside India. Such transfers shall be undertaken in compliance with applicable legal safeguards.

15. CHILDREN’S DATA

The Platform is not intended for individuals under eighteen years of age. We do not knowingly collect personal data from minors.
